1. Acceptance of Terms
By accessing or using the ChariotOps platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these terms.
2. Account Terms
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account and password. ChariotOps cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
3. Service Description
ChariotOps provides a SaaS platform for luxury ground transportation operators, including booking management, dispatch, driver management, payment processing (via Stripe Connect), and related tools. The specific features available depend on your subscription plan.
4. Payment Terms
Subscription fees are billed monthly or annually in advance. A per-ride platform fee of $3.00 (or as otherwise agreed) is charged per completed ride. Overage charges apply when ride volume exceeds your plan's included rides. All fees are non-refundable except as required by law. Stripe Connect is used for ride payment processing; operators maintain their own Stripe accounts.
5. Acceptable Use
You may not use the Service for any unlawful purpose, to violate any laws, to infringe on intellectual property rights, to transmit malicious code, to interfere with the Service's operation, or to impersonate any person or entity. You are responsible for all content and activity on your account.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by ChariotOps and are protected by international copyright, trademark, and other intellectual property laws. Your data remains your property; you grant ChariotOps a limited license to process it solely for providing the Service.
7. Limitation of Liability
In no event shall ChariotOps, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
8. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your account immediately if you breach these terms. Upon termination, your right to use the Service ceases immediately. We will provide your data in a standard format upon request within 30 days of termination.
9. Governing Law
These terms shall be governed by the laws of the State of Georgia, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Fulton County, Georgia.
